In February 2023, in Cleveland, Ohio, the claimant was leaving a privately owned, paid parking lot attached to a concert venue when an automatic gate malfunctioned and closed on the passenger side of their 2020 Toyota RAV4, causing significant damage. The claimant promptly reported the incident to the parking lot management and obtained both photographic evidence and a verbal recording of a parking lot attendant acknowledging that this malfunction had occurred on at least three previous occasions—demonstrating the property owner’s prior knowledge of the hazard. Despite attempts to resolve the matter through direct communication, the property management was unresponsive until a family member (an attorney) intervened via email. Ultimately, the claimant was forced to file a claim through GEICO, paying a $500 deductible and enduring an extended delay in vehicle repairs. The claimant is now seeking legal representation to pursue recovery of the deductible, compensation for the prolonged inconvenience, reimbursement for the diminished value of the vehicle following repairs, and additional damages due to the property owner’s negligence and failure to act despite prior incidents.
